According to Model Rule of Professional Conduct 1.1, comment 8, “To maintain the requisite knowledge and skill, a lawyer should keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology.” Generative AI (GenAI) provides both benefits and risks. ABA Formal Opinion 512 provides guidelines for using GenAI. Under Federal Rule of Civil Procedure 11(b), judges have issued sanctions for improper use of GenAI. This tension between risk and competence provides a great launching point for teaching law students how to use GenAI responsibly. This presentation will provide sample lessons based on this paradigm.
